Whistleblower protections — Pennsylvania

Pennsylvania protections

Pennsylvania's Whistleblower Law was enacted to protect from retaliation employees of public-sector and employees of publicly funded groups who report, object to or refuse to participate in any violation of law, rule or regulation by their employer and provides as follows:

  • An employer may not take any retaliatory action against an employee because the employee has made a good faith report, or is about to report, verbally or in writing, to the employer appropriate authority an instance of wrongdoing or waste.
  • No employer my take any retaliatory action against an employee because the employee is required by an appropriate authority to participate in an investigation, hearing or inquiry held by an appropriate authority or in a court action.

Retaliatory actions include discrimination or retaliation in regard to the employee's compensation, terms, conditions, location or privileges of employment.

An employee who has been the object of a retaliatory personnel action in violation of this act may institute a civil action in a court of competent jurisdiction within two years after discovering that the alleged retaliatory personnel action was taken or within four...
