Verifying an applicant's work eligibility

The law requires employers to employ only those persons authorized to work in the United States. Employers are required to verify the identity and employment eligibility of all individuals hired after November 6, 1986, regardless of how many people the company employs. Verification of identity and employment eligibility is accomplished by completing a Form I-9. It is critical that employers use the most up to date version of the Form I-9. The latest version has a date of October 21, 2019, on the lower left-hand corner and an expiration date of October 31, 2022, on the upper right-hand corner. The I-9 form may be downloaded in English and Spanish from the U.S. Citizenship and Immigration Services website:

Employers must be careful not to engage in document abuse discrimination in this process by specifying which documents an employee should present, requiring more documents than are minimally necessary or rejecting documents that reasonably appear to be genuine.
