Workers’ compensation — North Carolina

The North Carolina Workers’ Compensation Act generally provides the exclusive remedy for most employees who are injured on the job or suffer an occupational disease. Some exceptions apply. All injuries must “arise out of and in the course and scope of” the covered employment to be compensated. In the case of occupational disease, the employment must have significantly contributed to or been a significant factor in causing, the disease’s development and exposed the worker to a greater risk of contracting the disease than the public generally. Where an employee is exposed to the same injurious agent at the place of business of more than one employer, the claim should be filed with the employer on whose premises he or she was last injuriously exposed.

Coverage

The Act requires that all businesses (some limited exceptions apply) that employ three or more employees obtain workers’ compensation insurance or qualify as self-insured employers for purposes of paying workers’ compensation benefits to their employees. Businesses with just one employee, whose work involves the presence of radiation, are required to have workers’ compensation coverage.
