Drugs and alcohol — North Carolina

Drug and/or alcohol testing is mandated by federal law for certain positions in certain industries, including safety sensitive positions in aviation, trucking, railroads, mass transit, pipelines and other transportation industries. The Department of Transportation (DOT) has published rules on who must conduct drug and alcohol tests, how to conduct those tests and what regulations to use when testing. The regulations should be strictly adhered to by covered employers. Employers who hold certain defense contracts must comply with the Department of Defense drug testing regulations. The Department of Energy requires drug and alcohol testing for covered workers in positions that affect the environment, public health and safety or national security. The Nuclear Regulatory Commission requires drug testing of nuclear plant workers and the National Aeronautics and Space Administration requires drug testing for contractors who perform safety sensitive security or national functions. North Carolina employers who have employees covered by these requirements must conduct the testing in accordance with the applicable regulations.
