Wages and hours — North Carolina

Most North Carolina employers will be required to comply with both the federal Fair Labor Standards Act (FLSA) as well as certain portions of the North Carolina Wage and Hour Act (NCWHA). While the FLSA generally imposes minimum wage, overtime, equal pay and recordkeeping requirements on employers that are covered by that law, the North Carolina law imposes minimum wage and overtime requirements on employers/employees that are not covered by federal law and, most importantly, imposes a variety of wage payment obligations on all employers. North Carolina law also imposes youth employment and recordkeeping obligations.

The North Carolina Wage and Hour Act

The North Carolina Wage and Hour Act (NCWHA) minimum wage and overtime provisions apply primarily to establishments doing less than $500,000 annual gross volume; however, some employees are exempt from these provisions. Detailed information about North Carolina’s wage law can be found at:

Minimum wage rate

The minimum wage rate is $7.25 per hour and will increase with the FLSA minimum wage.
