Responding to a government officer
There are many government agencies that may conduct investigations relating to an employee’s identity or work authorization. If a government officer from Immigration and Customs Enforcement (ICE), the Occupational Safety and Health Administration (OSHA), the police, border patrol, a welfare or unemployment agency, or other government entity approaches a company representative and requests information on the company or a company employee, the representative may:
direct the officer to the supervisor, on-site manager, or company’s attorney and allow that person to deal with the officer directly, politely stating:
“I am sure that the company will cooperate. However, I am not the person to provide you with that information. Let me get my supervisor or our lawyer who can work with you.”
follow the steps outlined herein if there is no supervisor available or the officer will not wait to allow the individual to find a supervisor:
State: “I am sure the company will cooperate. However, I am not the person to handle your request. Let me get some information and get the person who should handle this for you.”
