Immigration visas — E-Verify

Foreign workers

As discussed under the topic heading Immigration and employment, foreign nationals must apply for and receive authorization to lawfully live and work in the United States. The U.S. Department of Homeland Security (DHS) Bureau of Citizenship and Immigration Services (USCIS) oversees the visa and permanent immigration processes.

Employers may hire foreign nationals who have an unexpired Permanent Resident Card or other temporary work authorization who are in the United States and engaging in activities consistent with their visa. There are also two primary ways in which an employer can obtain the services of a specific foreign national employee. The first avenue is to pursue a non-immigrant visa. These various work visas provide temporary work eligibility for employees. Employees working under these visas are generally required to work for the sponsoring employer, and the visa is valid only for a specific amount of time. Although not a quick process, this is generally the fastest option to pursue; but companies often run into various roadblocks along the way, including sometimes very strict eligibility requirements and caps on the number of visas that can be issued.
