E-Verify regulations for federal contractors and subcontractors — E-Verify

Federal contractors must comply with employment verification regulations

On June 6, 2008, President Bush amended an executive order originally issued by President Clinton requiring all federal contractors to comply with the Immigration and Nationality Act (INA) as amended by the Immigration Reform and Control Act (IRCA). The executive order requires all federal contractors to use an electronic employment eligibility verification system, designated by the Department of Homeland Security (DHS), to verify the employment eligibility of:

  • all persons hired during the contract term by the contractor to perform employment duties within the United States
  • all persons assigned by the contractors to perform work on the federal contract within the United States.

The premise of the executive order is that contractors who employ unauthorized workers (even unknowingly) are less stable and dependable and have higher turnover, therefore undermining the overall efficiency and economy in government contracting. A more stable workforce will promote efficiency and economy in government contracting. The President of the United States (POTUS) has the authority to prescribe policies and directives governing federal procurement that would promote an economical and efficient procurement system.
