Compliance thresholds — South Carolina

The employment relationship is probably the most heavily regulated subject in this country. Since most individuals are either employees or employers, employment law affects a large percentage of the population. The law comes principally from three sources:

  1. contracts

  2. common law

  3. statutes.

Introduction to contracts

Restrictions on the employment relationship may come from employers or employees. Although South Carolina recognizes that the employment relationship may be at-will, where either the employer or the employee may end the relationship at any time and for any reason, employment may involve some kind of contractual undertaking and the terms of that contract may range from the very simple to the extremely complex. A contract is like a private statute, custom fit to the particular circumstances of the parties. An employer and an employee may agree to regulate their relationship in any way they want and with as much detail as they feel is appropriate, provided they stay within the boundaries of all pertinent laws and public policy.
