Enforcement — South Carolina

Employment and labor laws are enforced by a large number of administrative agencies and courts. Most of the state and federal employment and labor law statutes are administered and enforced, at least at the initial stages, by an administrative agency.

Federal agencies

National Labor Relations Board 

The National Labor Relations Board (NLRB), its general counsel and the various regional offices have jurisdiction over unfair labor practice charges and administer the National Labor Relations Act's (NLRA’s) provisions regarding union elections. 

The NLRB itself consists of five members appointed by the president for five-year terms. The NLRB reviews all unfair labor practice cases brought before it by the general counsel after the initial decision has been made by an administrative law judge (ALJ). The NLRB also has authority over union election matters, although it has delegated most of this responsibility to the regional directors, subject to review.

The president appoints the general counsel for a four-year term. The general counsel operates independently of the NLRB and is responsible for investigating and prosecuting unfair labor practice charges. Most of the general counsel’s work is done through the regional offices. The regional office covering South Carolina is located in Winston-Salem, N.C. and...
