Fair Labor Standards Act

How long an employee can work and how much money the employee must be paid for this work are both issues extensively regulated by state and federal law. The Fair Labor Standards Act (FLSA) is the flagship of federal wage and hour regulation.

Coverage

Any employee who does any of the following:

  • is involved in the movement of goods in interstate commerce
  • produces goods that will travel in interstate commerce
  • handles goods that have moved in interstate commerce
  • is covered by the FLSA if that employee works for an employer who has an annual gross volume of sales or business that is $500,000 or more.

Some businesses are covered regardless of the dollar volume of business. These include all of the following:

  • hospitals
  • institutions providing residential care for the sick, aged or mentally ill
  • schools
  • institutions of higher learning.
