Basic hiring practices — South Carolina

Many employers get into legal trouble before the employment relationship even begins. This topic will discuss those difficulties and how to avoid them.

Job advertisements

The statutes that prohibit employment discrimination on the basis of race, color, national origin, religion, age, disability and other protected categories also prohibit employers from publishing advertisements that indicate a preference for or bias against, applicants on the basis of those characteristics. Words and phrases that are potentially problematic include the following:

  • “Able bodied,” “strong back” or “agile.” These words and phrases could be seen as discriminating against an applicant’s disability.

  • “Attractive lady” or “career-minded man.” These phrases could be seen as discriminating against an applicant based on sex.

  • “Recent college grads” or “new blood.” These phrases could be seen as discriminating against an applicant’s age.

  • “Americans only,” “seeking immigrant labor” or “English must be your first language.” These phrases could be seen as discriminating against an applicant based on his or her national origin.

Employers should avoid using sex-specific titles like “meter maid” and “fireman.” A job ad should always include the notice...
