Immigration — Georgia

Immigration laws applicable in Georgia consist not only of significant federal regulations, but also state laws that impose a variety of additional requirements upon many Georgia employers.  This chapter:

  • outlines employer requirements under the Georgia Security and Immigration Compliance Act and Illegal Immigration Reform and Enforcement Act
  • discusses Form I-9 employment eligibility verification and E-Verify requirements

Required paperwork to verify employment eligibility

The Immigration Reform and Control Act (IRCA) prohibits the hiring or continued employment of persons whom employers know are unauthorized to work in the United States. To comply with the law, employers must verify the employment eligibility and identity of all employees hired after November 6, 1986 by completing Form I-9 for all employees, including U.S. citizens. Employers must retain Form I-9 for each employee for whichever is later of the two dates below:

  1. three years after the date of hire
  2. one year after employment is terminated
