Miscellaneous forms and policies — South Carolina Templates

The following forms are samples that various South Carolina companies use. These forms are not necessarily legally required but could be valuable in day-to-day operations.

Affirmative action standard

Despite receiving lots of publicity (particularly regarding college admissions), affirmative action requirements apply only in limited circumstances in the employment context. Executive Order 11246 requires non-construction contractors/subcontractors with 50 or more employees to develop a written affirmative action program (AAP) for each of their establishments within 120 days from the start of the federal contract, if they:

  • have a federal contract or subcontract of $50,000 or more
  • have government bills of lading, which in any 12-month period total, or can reasonably be expected to total, $50,000 or more
  • serve as a depository of federal funds in any amount
  • are financial institutions that issue and pay agents for U.S. savings bonds and savings notes.

Courts also can require employers to maintain affirmative action programs to eradicate discrimination and employers voluntarily can undertake affirmative action initiatives. Employers who are covered should update themselves on the new requirements for veterans and persons with disabilities.
