The Consolidated Omnibus Budget Reconciliation Act (COBRA) is a federal law that requires that most employers extend group health plan coverage to covered employees, spouses and/or dependents that would otherwise lose coverage.
Coverage
All employers who maintain a group health plan are subject to COBRA rules unless either of the following situationsare applicable:
The employer employed fewer than 20 employees (counting full-time and part-time) on a typical business day during the previous calendar year. Part-time employees are counted as partial employees. Also, for purposes of the 20-employee threshold, employees of related companies are grouped together.
The employer is a governmental entity or a church.
Note: State and local governmental employers may be subject to similar rules under the Public Health Services Act.
COBRA covers only group healthcare plans, including the following:
medical
dental
vision
prescription drugs
health maintenance organizations
health insurance flexible spending accounts (these plans are subject to special limitations under the COBRA rules).
