Federal contractors and affirmative action — Missouri

Certain federal legal authorities ban discrimination and require federal contractors and subcontractors to take affirmative action to ensure that all individuals have equal opportunity for employment, without regard to:

  • race
  • color
  • religion
  • sex
  • sexual orientation
  • gender identity
  • national origin
  • disability
  • protected veteran status.

The Office of Federal Contractor Compliance Programs (OFCCP) administers and enforces three legal authorities that require equal employment opportunity and affirmative action:

  1. Executive Order 11246
  2. Section 503 of the Rehabilitation Act of 1973
  3. the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA).

Each of these laws requires federal contractors and subcontractors to take certain compliance steps in order to continue to engage in federal contract and subcontract work. One of the more onerous of these compliance requirements is implementation of a written Affirmative Action Plan (AAP), which is required if a business has federal contracts and subcontracts of a certain dollar amount and 50 or more employees.
