On January 21, 2016, the EEOC released proposed changes to its guidance on workplace retaliation. The proposed changes would significantly broaden the definition of retaliation and reflects the EEOC’s aggressive stance against retaliation. Specifically, the guidance expands on the three elements of a retaliation claim: (1) protected activity; (2) adverse employment action; and (3) the existence of a causal connection between the protected activity and the adverse employment action. This webinar will review these changes and discuss the impact on employers and their dealings with employees who engage in a protected activity.
