Employers face a two-front battle in relation to defending legal claims related to employee exposure to COVID-19 in the workplace. OSHA has already received tens of thousands of complaints, and many employers will face potential investigations from state and federal safety authorities in the months ahead. Although many states are passing liability shields for employers, there is still the prospect for wrongful death lawsuits on the horizon for many front line employers who have experienced a large number of employee cases.
