While federal law still generally dominates the labor and employment area, the legal standards for non-competition agreements remain a creature of state law. In recent years, state laws governing non-competition agreements and other post-employment restrictive covenants have evolved with some states limiting the reach of non-competes while some states have made them easier to enforce. For employers with multi-state (and global) operations, it is vital for HR Professionals to understand the latest legal developments to ensure that agreements with post-employment restrictions are compliant and enforceable.
