Gender Identity & Expression: Working Towards an Inclusive Workplace

In the past three years, New York State has recognized an increasing number of protections for employees on the basis of gender identity and expression. This presentation will cover relevant topics to help employers create a safe and productive working environment for all employees, including guidance on correct pronouns, restroom usage, religious objections and more.

The presentation will also provide an overview of the legal landscape under federal and state law as applicable to matters of gender identity and expression in employment, including: 

  • the Supreme Court’s 2020 decision in Bostock v. Clayton County; 
  • the application of gender dysphoria and related conditions to the Americans with Disabilities Act and the Family and Medical Leave Act; and 
  • protections under the New York Human Rights law and the Gender Expression Non-Discrimination Act.
