MO: Legislative Update: Punitive Damages Reform

Too often the threat of large, unpredictable punitive damage awards has been used as a litigation club to force settlements unrelated to the merits of a case. Senate Bill 591, signed into law this year, promotes greater predictability and fairness with respect to punitive awards. But it will only help put a stop to outlandish punitive damages if properly implemented. Defense attorneys must respond to any proposed attempts by plaintiff lawyers to circumvent or dilute the intended impact of the reform.
