While legislative sessions have not yet adjourned, 2021 is shaping up to be the busiest year ever for marijuana laws. For now, more than 30 states have legalized marijuana for medical use, and many of the laws have included antidiscrimination and job protection provisions for users of medicinal marijuana. More than 15 states have legalized marijuana for recreational use.

While employers may think that marijuana legalization is only a drug testing issue, it actually implicates a wide variety of topics, including federal and state statutory and regulatory compliance, disability discrimination, workplace safety, government contractor status, workers’ compensation, employee privacy, and public policy.
