Stearns Weaver Miller Weissler Alhadeff & Sitterson PA – Florida

Stearns Weaver Miller’s Labor and Employment Department provides counsel to employers large and small, in both the public and private sectors. We work with our clients to provide strategic preventive counseling, training, audits, and legal representation to complex and challenging workplace problems. We have in depth experience in dealing with unions seeking to represent blue collar, white collar, and professional employees. We have extensive experience advising and representing clients in their dealings with unions to ensure compliance with the National Labor Relations Act, and we also represent public and private sector employers in collective bargaining. We frequently represent clients before such administrative agencies as the Equal Employment Opportunity Commission, the Florida Commission on Human Relations and other state and local civil rights agencies.

Our practice is designed to help clients understand their complex legal obligations in every employment area, and to comply with federal, state, and local laws prohibiting employment discrimination. We practice “preventive” law, which requires sensitive counseling skills and the ability to write documents in clear, easy-to-understand English as opposed to “legalese.” As part of preventive law, we frequently advise employers on how to avoid employment discrimination or wrongful termination litigation.

We have extensive experience in federal trial and appellate courts litigating employment discrimination and employee benefit matters. This experience includes successfully defending employers in employment discrimination jury trials, as well as summary judgment and dismissal victories. We have litigated complicated actions asserting a myriad of claims under Title VII of the Civil Rights Act of 1964, the Family and Medical Leave Act of 1993, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Employee Retirement Income Security Act, the Fair Labor Standards Act, the Worker Adjustment and Retraining Notification Act, and the National Labor Relations Act, among others.

In addition to federal court litigation, our labor and employment lawyers have successfully represented clients in numerous state court lawsuits. These cases have included claims involving wrongful termination, covenants not-to-compete, breach of contract, invasion of privacy, defamation, intentional infliction of emotional distress, assault, battery, and Florida’s whistleblower statute.
