To Be or Not to Be: An Employee or An Independent Contractor

Presented by Kathy Speaker MacNett

Presented by Kathy Speaker MacNett of SkarlatosZonarich. Many employers are unaware of the pitfalls of misclassifying an employee as an independent contractor. The Department of Labor, the Internal Revenue Service (“IRS”), and a variety of state administrative agencies have little sympathy for such misclassifications. These misclassifications result in huge employment and tax ramifications, including the possibility of coverage under discrimination and wage and hour laws that employers may believe do not apply. This webinar will explore the factors frequently applied by the IRS and the courts to make such a determination, and a sampling of illustrative cases. It is designed to answer questions for first time attendees as well as refreshing and updating the understanding of longer term human resource professionals
