The Department of Labor, the Internal Revenue Service (“IRS”), and a variety of state administrative agencies have little sympathy for such misclassifications. These misclassifications result in huge employment and tax ramifications, including the possibility of coverage under discrimination and wage and hour laws that employers may believe do not apply.
