December was an eventful month for the National Labor Relations Board (NLRB). The Board finalized a rule reversing problematic provisions contained in the 2014 “ambush” election regulations and issued a number of other extremely important decisions. Some of the topics include the following:

• Dues checkoff after the expiration of a collective bargaining agreement

• Confidentiality during workplace investigations

• Employee use of employer email for union and concerted activity

• Arbitration agreements and residual issues after Epic Systems

• Insights on the joint-employer issue in the context of franchisor-franchisee liability

Join this webinar as attorneys from Ogletree Deakins’ Traditional Labor Practice Group offer insights into the new rule and rulings, and discuss developments we are likely to see in early 2020 on the joint-employer standard, the impact of profane language on protected concerted activity, and the organizing rights of graduate students in higher education, among other topics.
