Time off for victims of a crime

Virginia’s Victim’s Leave Act applies to all employers and requires employers to permit employees who are victims of crimes to attend related criminal proceedings provided the employee gives the employer certain notices (i.e., copies of subpoenas) for such proceedings. Employers are not required to pay employee-victims for this time. Employers are also not required to grant such leave if it would create an undue hardship. Employers should also be aware that the Virginia Victim’s Leave Act prohibits discrimination against crime victims in the workplace.

Families First Coronavirus Response Act

On March 18, 2020, President Trump signed into law the Families First Coronavirus Response Act (FFCRA), which aims to provide initial relief to small and midsize employers and employees. The act provides paid sick leave under the Emergency Paid Sick Leave Act (EPSLA) and expands the Family and Medical Leave Act (FMLA) to include coverage for emergency family leave under the Emergency Family and Medical Leave Expansion Act (EFMLEA) for COVID-19 related reasons and creates refundable paid sick and childcare leave credits for eligible businesses.
