An Introduction — North Carolina

Companies that employ workers in North Carolina must comply with both federal and North Carolina employment laws. While some of these laws apply to all companies, others apply only after the company reaches a certain size (e.g., 15 employees). This chapter provides a snapshot of the North Carolina non-government employer’s legal obligations. Each of these obligations is discussed in more detail with practical compliance tips in later chapters.

Hiring

  • All companies that use outside vendors to perform background checks or provide information on applicants/employees must comply with the federal Fair Credit Reporting Act (FCRA) that imposes strict requirements on disclosures, authorization and pre- and post-use of information obtained.
  • All companies (unless otherwise noted) are prohibited from discriminating against applicants and employees on the following bases:
    • race, veteran status/military service (including need for leave to engage in training activities)
    • need for leave to participate in activities at child’s school (four hours per year) or to fulfill juvenile order obligations
    • need for time off to seek a no contest order or pursue other rights in connection with domestic...
