E-Verify — E-Verify

In an attempt to address problems with the employment of unauthorized workers and the employment verification procedures, the federal government, under the Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA), created three employment eligibility verification pilot programs: 

  1. the Basic Pilot Program
  1. the Citizens Attestation Program
  1. the Machine Readable Program.

The only one that continues to be in use is the Basic Pilot Program, which has been renamed E-Verify. E-Verify is an Internet-based system that is jointly administered by the Social Security Administration (SSA) and the Department of Homeland Security (DHS).

More than 967,000 employers across the United States are enrolled in E-Verify and use it at 2.4 million hiring sites. According to USCIS, nearly 1,500 new companies enroll in E-Verify each week. Several states have passed laws that require some employers (those with state government contracts) to use E-Verify. The federal government passed regulations requiring companies with federal contracts to use E-Verify. Other states, such as Arizona, require all employers to use E-Verify. On a national level, however, E-Verify remains a voluntary program. There have been several bills introduced in the past few years that would require all employers in the...
