Wages and hours — Missouri

The primary federal law regulating employee wages and hours of employment is the Fair Labor Standards Act (FLSA). The FLSA was originally enacted in 1938 and has been amended a number of times since. All other federal laws establishing wage and hour standards, such as the Davis Bacon Act, the Walsh-Healey Act and the Service Contract Act, apply only to employers who have contracts to perform tasks for the federal government.

Overview

The Fair Labor Standards Act (FLSA) regulates the wages and hours of work of those employees in both private and public sectors who fall within the law. In determining what employees fall within the scope of the FLSA, it must be determined whether:

  • the work occurs within the geographic area covered by the FLSA
  • whether the party that pays the individual for their services is an employer subject to the FLSA
  • whether the individual is an employee or an independent contractor
  • whether particular circumstances place the individual outside coverage of the FLSA.
