Enforcement — Wages/Hours

The Wage and Hour Division of the Department of Labor (DOL) administers and enforces the FLSA with respect to both private and public employment.

Cause for investigations

The DOL may begin an investigation for a number of reasons. Many investigations stem from employee complaints. These complaints are confidential and the name of the employee is not disclosed to the employer. Sometimes competing businesses will report violations to the DOL. The DOL may also target certain industries or geographic locations for investigation in order to improve overall employer compliance.

Inspecting a place of business with no warning

In connection with this enforcement, a compliance officer from the DOL may enter any place of business of any employer for the purpose of inspecting the books, payrolls or other records relating to wages, hours and conditions of employment. The employer must allow this inspection, which may be unannounced. However, the employer may delay the investigation briefly if the employer is unable to meet with the compliance officer due to prior commitments or to secure the services of an attorney, accountant or other advisor.
